1 Definitions
“Layerhouse” means Layerhouse LLC, the company operating the platform at layerhouse.io.
“Platform” means the Layerhouse website, applications, and services.
“Track” means any audio file, including music, sound effects, stems, and loops, available for download on the Platform.
“License” means the rights granted to you under this Agreement to use a Track.
“Licensee” or “you” means the individual or entity that has agreed to this Agreement and downloaded a Track.
“Content” means any video, podcast, game, film, advertisement, or other creative work you produce that incorporates a Track.
“Subscription” means an active paid plan (Creator or Pro) on the Platform.
“Active Subscription Period” means the time during which your Subscription is current and paid.
“Stems” means individual audio components of a Track (e.g., drums, bass, melody, pads) available as separate files.
2 Grant of License
Subject to the terms of this Agreement and your applicable plan, Layerhouse grants you a non-exclusive, worldwide, royalty-free license to use Tracks downloaded during your Active Subscription Period in Content you create, as specified below.

2.1 Free Plan License
If you are on the Free Plan, you may:
- –Download up to five (5) Tracks per calendar month
- –Use downloaded Tracks in personal, non-commercial Content
- –Publish Content on YouTube, podcasts, social media, and personal websites
- –Continue using Tracks in Content already published, indefinitely
Free Plan downloads are provided in MP3 format (320kbps) only. WAV format downloads are available on Creator and Pro plans.
You must credit Layerhouse in the format: “Music by [Artist Name] via Layerhouse (layerhouse.io)”
2.2 Creator Plan License
If you are on the Creator Plan during an Active Subscription Period, you may:
- –Download an unlimited number of Tracks
- –Use downloaded Tracks on YouTube, Vimeo, and similar video platforms
- –Use downloaded Tracks in podcasts on any podcast platform
- –Use downloaded Tracks on TikTok, Instagram, Facebook, Twitter/X, and YouTube Shorts
- –Use downloaded Tracks in live streaming on Twitch, YouTube Live, and similar platforms
- –Use downloaded Tracks in indie games with a commercial game license (see Section 2.4)
- –Monetize Content through platform ad revenue, sponsorships, and memberships
- –Continue using Tracks in Content already published after your Subscription ends
No attribution to Layerhouse is required on the Creator Plan.
2.3 Pro Plan License
If you are on the Pro Plan, you may do everything permitted under the Creator Plan, plus:
- –Use Tracks in commercial advertisements and branded content
- –Use Tracks in client work produced on behalf of third parties
- –Use Tracks in film, television, and productions for broadcast or theatrical release
- –Use Tracks in corporate videos, presentations, and internal communications
- –Use Tracks in radio and podcast advertisements
- –Download Stem files where available
2.4 Game Developer License
Creator and Pro plan subscribers may use Tracks in video games including indie games sold commercially on Steam, itch.io, App Store, Google Play, and similar platforms, browser-based games, mobile games, and virtual reality experiences.
3 Restrictions
Regardless of your plan, you may not:
- ×Resell or redistribute — Sell, sublicense, rent, or transfer the Tracks themselves to any third party
- ×Claim authorship — Register, claim, or represent that you composed or own the Tracks
- ×Content ID registration — Register any Track with YouTube Content ID, Facebook Rights Manager, or similar systems
- ×NFTs and blockchain — Use Tracks as the primary asset in NFTs or cryptocurrency projects
- ×Stock media redistribution — Upload Tracks to competing stock music platforms
- ×Standalone audio distribution — Release Tracks on Spotify, Apple Music, or similar platforms as your own music
- ×Harmful content — Use Tracks in content promoting hatred, discrimination, or violence
- ×Illegal content — Use Tracks in content that violates any applicable law
4 Platform-Specific Terms
4.1 YouTube
All Tracks on Layerhouse are cleared for use on YouTube. Layerhouse will not file Content ID claims against Content containing properly licensed Tracks. If you receive a Content ID claim on properly licensed Content, contact support@layerhouse.io with your license details and we will assist in resolving the claim.
4.2 TikTok, Instagram Reels, and Short-Form Platforms
Tracks are cleared for use in short-form video content. Platform-level music licensing restrictions that exist independently of Layerhouse’s license are outside our control. Creator and Pro plans provide the broadest available clearance.
4.3 Twitch and Live Streaming
Tracks may be used in live streams on Creator and Pro plans. We recommend keeping your license confirmation email as proof of licensing, as streaming platforms may have independent music detection systems.
5Subscription & Perpetual License
5.1 During Active Subscription
During an Active Subscription Period you may download Tracks and use them in Content as specified in Section 2.
5.2 After Cancellation — Perpetual License for Published Content
5.3 After Cancellation — No New Downloads
After your Subscription ends you may not download new Tracks or use previously downloaded Tracks in new, unpublished Content. To use Tracks in new Content you must resubscribe.
5.4 Free Plan
The Free Plan license terms apply for as long as you maintain a Free Plan account in good standing.
6Ownership & Copyright
6.1 Artist Ownership
All Tracks on the Platform are original works owned by the artists who created them. Layerhouse holds a non-exclusive license from each artist to sublicense Tracks to Platform users under these terms.
6.2 No Transfer of Ownership
This Agreement does not transfer any ownership, copyright, or intellectual property rights in any Track to you. You are receiving a license to use the Tracks — not purchasing ownership of them.
6.3 Your Content
You retain full ownership of the Content you create. Layerhouse claims no ownership over your videos, podcasts, games, or other creative works.
7 License Documentation
Upon downloading a Track, Layerhouse will generate a license record in your account showing the Track title and artist, your account identifier, the license type (Free / Creator / Pro), and the date of download. License records are accessible in your account dashboard. We recommend saving your license confirmation emails as proof of licensing.

10 Indemnification
You agree to indemnify, defend, and hold harmless Layerhouse, its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of Tracks in violation of this Agreement, your Content, your violation of any applicable law, or your infringement of any third-party rights.
11 Termination
11.1 By You
You may terminate this Agreement at any time by canceling your Subscription and deleting your account. Perpetual licenses for published Content survive termination as described in Section 5.2.
11.2 By Layerhouse
Layerhouse may terminate or suspend your access if you materially breach this Agreement and fail to cure the breach within 14 days of written notice.
11.3 Effect of Termination
Upon termination, your right to download new Tracks ends immediately. Your perpetual license for previously published Content remains in effect.
12Governing Law & Dispute Resolution
This Agreement is governed by the laws of the State of Texas, United States. Disputes shall first be addressed through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Harris County, Texas, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property violations.
13 Changes to This Agreement
Layerhouse may update this Agreement from time to time. We will notify you of material changes by email and by posting a notice on the Platform at least 30 days before changes take effect. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Agreement.
14 General
Entire Agreement: This Agreement constitutes the entire agreement between you and Layerhouse regarding your use of Tracks and supersedes all prior agreements.
Severability: If any provision is found unenforceable, the remaining provisions continue in full effect.
No Waiver: Layerhouse’s failure to enforce any provision does not waive its right to do so in the future.
Assignment: You may not assign your rights under this Agreement without Layerhouse’s prior written consent. Layerhouse may assign this Agreement in connection with a merger, acquisition, or sale of assets.
